罰則は法律で定めなければならない法律主義と罰則は施行後の行為にだけ適用され、施行前の行為に遡って適用することはできない遡及処罰の禁止という原則である。
犯罪の中には、法益が実際に侵害されるのを待たずにそれ以前の段階で成立するものがあり法益が侵害される可能性・危険性が生じた段階であるため危険犯と呼ばれている。
